To use F95Zone, you must meet the following eligibility requirements:

• Age Requirement: You must be at least 13 years of age to access F95Zone. Users between 13 and 18 must have the consent of a parent or legal guardian
• Legal Capacity: You must have the legal capacity to enter into a binding agreement. If you are using the platform on behalf of an organization, you represent that you have the authority to bind that organization to these Terms
• Jurisdiction: You are responsible for ensuring that your use of F95Zone complies with all applicable local, state, national, and international laws and regulations in your jurisdiction
• No Prior Bans: You must not have been previously banned or had your account terminated by F95Zone for violations of these Terms or community guidelines

F95Zone reserves the right to refuse service, terminate accounts, or restrict access at our sole discretion if eligibility requirements are not met.

While browsing and downloading games on F95Zone does not require an account, certain features require registration. When creating an account, you agree to the following:

• Accurate Information: You must provide accurate, current, and complete information during registration and keep your profile updated

Service Availability: We strive to maintain continuous access to F95Zone but do not guarantee uninterrupted, error-free, or secure operation. The platform may be temporarily unavailable due to maintenance, updates, server issues, or circumstances beyond our control.

Third-Party Content: Games, mods, and other downloadable content available on F95Zone are primarily created and provided by third-party developers and community members. F95Zone does not claim ownership of third-party content and is not responsible for its accuracy, quality, safety, or legality.

Download Responsibility: By downloading any content from F95Zone, you acknowledge that:

F95Zone is committed to fostering a safe, respectful, and inclusive gaming community. All users must adhere to these guidelines when participating in forums, comments, reviews, and other community features:

• Be Respectful: Treat all community members with respect. Harassment, bullying, personal attacks, hate speech, and discrimination based on race, gender, religion, nationality, sexual orientation, or disability are strictly prohibited

To the maximum extent permitted by applicable law, in no event shall F95Zone, its owners, operators, employees, agents, partners, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

• Damage to your computer system, mobile device, or data resulting from your use of the platform
• Any unauthorized access to or alteration of your transmissions or data
• Any interruption or cessation of the platform's services
• Any bugs, viruses, or other harmful components transmitted through the platform by third parties

In no event shall F95Zone's total aggregate liability exceed one hundred US dollars ($100.00). This limitation applies regardless of the theory of liability and even if F95Zone has been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you in its entirety.

Termination by F95Zone: We may suspend or terminate your account and access to the platform at any time, with or without cause, with or without notice, for any reason, including but not limited to:

• Violation of these Terms of Service or community guidelines
• Engaging in fraudulent, abusive, or illegal activities
• Uploading malicious content or malware
• Repeated copyright infringement
• Conduct that harms other users or the platform

Termination by User: You may terminate your account at any time by contacting us at info.f95zoned@gmail.com with a request to delete your account. Upon termination, your account data will be handled in accordance with our Privacy Policy.

Effect of Termination: Upon termination, your right to use the platform ceases immediately. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, limitation of liability, and indemnification.

In the event of any dispute arising from or relating to these Terms or your use of F95Zone, you agree to the following dispute resolution process:

1. Informal Resolution: Before filing any formal claim, you agree to first attempt to resolve the dispute informally by contacting us at info.f95zoned@gmail.com. We will attempt to resolve the dispute within 30 days of receiving your notice.

2. Mediation: If informal resolution fails, both parties agree to submit the dispute to non-binding mediation administered by a mutually agreed-upon mediator in Santa Clara County, California.

3. Arbitration: If mediation fails, any remaining dispute shall be resolved through binding arbitration conducted in Santa Clara County, California, in accordance with the rules of the American Arbitration Association. The arbitrator's decision shall be final and binding.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration against F95Zone.

These Terms of Service and any disputes arising out of or related to these Terms or the use of F95Zone shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law principles.

You irrevocably consent to the exclusive jurisdiction and venue of the state and federal courts located in Santa Clara County, California, for any actions arising out of or relating to these Terms or your use of the platform.

If you are accessing F95Zone from outside the United States, you are responsible for compliance with local laws to the extent that local laws are applicable. You agree not to use F95Zone in any jurisdiction where the content or use of the platform would be unlawful.

F95Zone reserves the right to modify, amend, or replace these Terms of Service at any time at our sole discretion. When we make changes:

• The "Effective" date at the top of this page will be updated to reflect the date of the most recent revision
• For material changes that significantly affect your rights or obligations, we will provide notice through a prominent announcement on the platform or via email to registered users

Force Majeure: F95Zone shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, war, terrorism, riots, government actions, power failures, internet disruptions, or pandemics.

Headings: Section headings in these Terms are for convenience only and shall not affect the interpretation of any provision.
