For the fastest response, we recommend submitting your notice via email with "DMCA Takedown Notice" in the subject line.

If you are a copyright owner or an authorized agent and believe that content hosted on F95Zone infringes your copyright, you may submit a written DMCA takedown notice to our designated agent.

To be valid under 17 U.S.C. § 512(c)(3), your takedown notice must be a written communication that includes the following elements:

1. Identify the copyrighted work claimed to have been infringed. If multiple works are involved, provide a representative list
2. Identify the infringing material on F95Zone with enough detail for us to locate it (include specific URLs or page links)
3. Provide your contact information including your full legal name, mailing address, telephone number, and email address

• Identification of infringing material: Specific URLs on f95zoned.com where the infringing content is located. General descriptions without URLs may delay processing
• Complainant's contact information: Full legal name, physical address, email address, and phone number
• Good faith statement: A statement that you have a good faith belief that the material's use is not authorized by the copyright owner, its agent, or the law
• Accuracy statement under penalty of perjury: A statement that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner
• Signature: A physical or electronic signature of the copyright owner or authorized representative

Incomplete Notices: Notices that do not substantially comply with the above requirements may not be acted upon. If your notice is incomplete, we will attempt to contact you for additional information, but this may delay the takedown process.

Tip: Include as many specific URLs as possible for each piece of infringing content. The more precise your notice, the faster we can process it.

Upon receiving a valid DMCA takedown notice, F95Zone follows this process:

1. Acknowledgment (24-48 hours): We acknowledge receipt of your notice via email and assign a reference number for tracking
2. Verification (1-3 business days): Our team reviews the notice for completeness and verifies that it substantially complies with DMCA requirements under 17 U.S.C. § 512(c)(3)
3. Content Removal (3-5 business days): If the notice is valid, we expeditiously remove or disable access to the allegedly infringing material
4. Uploader Notification: We notify the user who uploaded the content that it has been removed due to a DMCA claim, providing them with a copy of the notice (excluding the complainant's personal contact details if requested)
5. Confirmation (5-10 business days): We send a confirmation to the complainant that the content has been removed or access has been disabled

Expedited Processing: In cases involving clear, large-scale infringement, we may expedite the removal process. For urgent matters, please indicate "URGENT" in the subject line of your email.

Preservation of Evidence: We may retain copies of removed content as necessary for legal purposes, ongoing disputes, or to comply with legal obligations.

If you believe your content was removed by mistake or misidentification, you may file a counter-notification under 17 U.S.C. § 512(g). A valid counter-notification must include:

• Your signature: Physical or electronic signature
• Identification of removed material: Identify the content that was removed and the location where it appeared before removal (include the specific URL)
• Statement under penalty of perjury: A statement that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification
• Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or Santa Clara County, California, if outside the US) and that you will accept service of process from the complainant
• Your contact information: Full legal name, address, phone number, and email address

Process After Counter-Notification:

1. We forward your counter-notification to the original complainant
2. The complainant has 10 business days to file a court action seeking a restraining order against you
3. If no court action is filed within 10-14 business days, we will restore the removed content
4. If a court action is filed, the content remains removed pending the outcome of the legal proceeding

In accordance with the DMCA and our commitment to protecting intellectual property, F95Zone maintains a strict repeat infringer policy:

• First Offense: The infringing content is removed, and the user receives a formal warning via email explaining the violation and consequences of repeated infringement
• Second Offense: The infringing content is removed, the user receives a final warning, and their upload privileges may be temporarily suspended for a period of 30 days
• Third Offense: The user's account is permanently terminated and they are banned from creating new accounts on the platform. All content uploaded by the user may be reviewed and removed at our discretion

Severity Considerations: In cases of willful, large-scale, or commercial copyright infringement, we reserve the right to immediately terminate a user's account without prior warnings. We consider the nature, scope, and intent of the infringement when determining appropriate action.

Record Keeping: We maintain records of DMCA notices received and actions taken to ensure consistent enforcement of this policy.

The DMCA provides important protections against misuse of the takedown process. All parties involved should be aware of the following:

For Copyright Holders Filing Notices:

• Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages, including costs and attorney's fees incurred by the alleged infringer or the service provider
• Before filing a takedown notice, you must consider whether the use of the material may constitute fair use under 17 U.S.C. § 107
• Filing false DMCA notices may constitute perjury and could result in legal liability

For Users Filing Counter-Notifications:

• Filing a counter-notification with false statements made under penalty of perjury may result in legal liability
• By filing a counter-notification, you consent to the jurisdiction of the courts and agree to accept service of process
• If the original complainant files a court action, the dispute moves to the judicial system

F95Zone takes all DMCA notices and counter-notifications seriously and expects all parties to act in good faith throughout the process.

F95Zone operates as an online service provider under 17 U.S.C. § 512 and qualifies for the safe harbor provisions of the DMCA. This means:

• User-Uploaded Content: Content on F95Zone is primarily uploaded by third-party users and community members. F95Zone does not pre-screen all content before it becomes available on the platform
• No Direct Infringement: F95Zone does not directly upload, create, or modify the content that users share on the platform
• Expeditious Removal: Upon receiving a valid DMCA notification, we act expeditiously to remove or disable access to the allegedly infringing material
• Designated Agent: We have registered a designated agent with the U.S. Copyright Office to receive DMCA notifications
• Repeat Infringer Policy: We maintain and enforce a policy for terminating accounts of repeat infringers in appropriate circumstances
• No Interference: We do not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works

These safe harbor protections do not apply if F95Zone has actual knowledge that material is infringing or is aware of facts or circumstances from which infringing activity is apparent, and fails to act expeditiously to remove or disable access to the material.
